Summary

Section 53A of the CGST Act is a backend accounting provision that mirrors the actions a taxpayer takes on the GST portal. When a business realizes it has excess money in its Central GST (CGST) cash ledger and transfers it to its State (SGST) or Union Territory (UTGST) cash ledger to pay a local tax liability, the actual tax revenue must be shifted between the governments. This section legally compels the Central Government to match the taxpayer's digital transfer by physically transferring an equivalent amount of real money from the Central tax account to the respective State or Union Territory's tax account. This entire mechanism was inserted into the law in late 2019 and went live on January 1, 2020, to support the newly introduced cash ledger transfer features.
